1. Overview
This Acceptable Use Policy ("AUP") governs the content you create and display using Promox digital signage equipment ("Equipment") provided by Black Crown Investments Pty Ltd (ABN 75 650 074 507, "Promox", "we", "us").
By using the Equipment, you agree to comply with this AUP.
2. Your Responsibilities
2.1. You are solely responsible for all content displayed on your Equipment ("Your Content"), regardless of which content management tool you use.
2.2. You must ensure Your Content complies with all applicable Australian federal, state, and local laws and regulations, including (but not limited to):
Australian Consumer Law (no misleading or deceptive advertising);
Competition and Consumer Act 2010;
Anti-Discrimination legislation;
Copyright Act 1968;
Privacy Act 1988;
Any local council signage regulations or permits applicable to your site.
2.3. You are responsible for obtaining any signage permits required by your local council for the display of digital signage at your location.
3. Prohibited Content
You must not display any content that:
Is unlawful, fraudulent, misleading, or deceptive;
Is defamatory, obscene, offensive, threatening, or harassing;
Contains or promotes hate speech, discrimination, or vilification based on race, religion, gender, sexual orientation, disability, or any protected attribute;
Contains sexually explicit material or nudity;
Promotes illegal drugs, underage drinking, or illegal gambling;
Infringes any third party's intellectual property rights (copyright, trademarks, patents);
Contains another person's personal information without their consent;
Promotes violence, terrorism, or self-harm;
Impersonates another person, business, or government entity;
Advertises tobacco products (prohibited under Australian law);
Breaches any advertising codes or standards applicable to your industry (e.g., AANA Code of Ethics, Alcohol Beverages Advertising Code).
4. Promox's Rights
4.1. Promox does not monitor Your Content. Content is managed locally on your device through a third-party app, and Promox does not have access to it.
4.2. However, if Promox becomes aware (e.g., through a complaint or observation) that content displayed on the Equipment breaches this AUP, Promox reserves the right to:
Request that you remove or modify the content;
Suspend your Rent-to-Own Agreement in cases of serious or repeated breaches;
Terminate your Agreement in cases of serious or repeated breaches (per the Terms of Service and Rent-to-Own Agreement).
4.3. Promox will notify you before taking any action under Section 4.2, except where immediate action is required to comply with law or prevent harm.
5. Content Guidelines (Best Practice)
While not mandatory, Promox recommends:
Keep content relevant and useful to your customers;
Ensure text is legible from the expected viewing distance;
Use high-resolution images and video for best display quality;
Rotate content regularly to keep messaging fresh;
Include required business information (e.g., liquor licence numbers where applicable);
Ensure promotions include relevant terms and conditions.
6. Consequences of Breach
6.1. If you breach this AUP, Promox may:
Issue a written warning and request remediation;
Suspend your Agreement until the breach is resolved;
Terminate your Agreement in the case of serious or repeated breaches (per the Terms of Service and Rent-to-Own Agreement).
6.2. You agree to indemnify Promox against any claims, fines, or damages arising from Your Content or your breach of this AUP.
7. Reporting Concerns
If you become aware of content on a Promox display that may breach this AUP, please contact us at support@promox.com.au.
8. Changes
Promox may update this AUP from time to time. We will notify you of material changes by email. Continued use of the Equipment after changes take effect constitutes acceptance.
